Merry Christmas! Picture this: under the tree at your favorite Christmas party, you open a present and someone has gifted you a gun. Everything is rosy, but what’s next? If the gift is complete, you also received ammo. Some states require you to register your gun within hours of receipt. Thankfully, Oklahoma has no gun registration laws. The gun is yours, and you are generally free to do with it as you will. So, how do you get your prize back to your house in Oklahoma?

Constitutional Carry

That’s easy. If you don’t have a Concealed Carry Permit, guess what? It’s after November 1st, 2019, and Oklahoma has constitutional carry. If you’re over the age of 21 and can pass a federal background check for the purchase of a firearm, you can legally carry your gun loaded under the new constitutional carry law. If you have a sling, you can openly carry your long gun. If you have a CCL or may carry constitutionally (meaning you’re not prohibited from carrying a firearm), you may transport magazine-loaded long guns, without a round in the chamber anywhere in the interior of your car. Loaded handguns may be carried openly or concealed, anywhere inside of your car.

Selling or Gifting a Gun

If you decide to sell or gift a gun, the best practice is to conduct the transfer using a Federal Firearm Licensee, or FFL, to do a background check on the person to whom you’re selling or giving the firearm. You would not want to accidentally transfer a gun to a felon, or person who couldn’t pass a background check. Such an indiscretion could cost you in legal fees or time in jail. One additional note: it is unlawful to transfer a firearm to a person who resides in another state, without using an FFL.
